Mediation is becoming increasingly popular. Courts, particularly in New Jersey, encourage or require parties to mediate in certain types of disputes. Further, parties may opt for mediation. In the divorce and family law area, mediation is becoming recognized as a very productive means of resolving divorce and family matters.

Mediation is voluntary. There is no obligation on the parties to agree to a settlement. The parties control the outcome. The process is facilitated by a trained mediator, who is an independent third party. The goal is for the parties to reach an agreement that is acceptable to all parties.

The New Jersey Uniform Mediation Act and Court Rule 1:40 (and the harmonized New Jersey Rules of Evidence 519) govern confidentiality of New Jersey mediations.
  • Neutral platform: The mediator is an impartial expert who is trained to guide the parties to a settlement. Unlike a judge, the mediator does not judge your case. They facilitate the process and ensure that the parties reach a settlement in an amicable manner.
  • Control over the outcome: No party is compelled to agree to reach any kind of settlement or to agree on any settlement. The parties may stop the process at any time.
  • Legal rights intact: The parties do not lose legal rights by mediating (as long as statutes of limitation and deadlines are not at issue). They can go back to litigation in case they feel that the process isn’t working for them.

Mr. Silverberg has completed: (i) the New York Bar Association Commercial Mediation Training, which is approved under Part 146 of the Rules of the Chief Administrative Judge, and (ii) the New York Bar Association Advanced Commercial Mediation training, which together provide the training required for service on the Commercial Division ADR roster. In addition, Mr. Silverberg actively participates the New Jersey Association of Professional Mediators, which is New Jersey’s largest mediation group, and is completing the New Jersey Association of Professional Mediators Divorce Mediation Training and Civil Mediation Training. As an active New Jersey mediator, he volunteers as a settlement mediator at Superior Court in Middlesex County.

Mr Silverberg has been a part of the legal profession as an attorney for more than 30 years. He has handled all kinds of disputes and negotiated many deals and settlements. He brings this experience to bear in every mediation.
